Terms and Conditions for Doodle - Kids Coloring App

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Doodle - Kids Coloring App ("the App", "our App", "Service") operated by Doodle ("us", "we", "our").
By downloading, installing, or using our App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the App.
1. Acceptance of Terms
By accessing or using our App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are a parent or guardian allowing a child to use the App, you accept these Terms on behalf of that child and are responsible for their use of the App.
2. Description of Service
Doodle is a drawing and coloring application designed for children and families. The App provides:
- Coloring pages across multiple themed categories
- Drawing tools including brushes, fills, stickers, and effects
- Augmented Reality (AR) experiences (BubbleAR)
- Ability to save and share artwork
- Optional premium features through subscription
3. User Eligibility
3.1 Age Requirements
- The App is designed for users of all ages, including children.
- Users under the age of 18 should use the App under the supervision of a parent or legal guardian.
- Parents or guardians are responsible for monitoring their children's use of the App.
3.2 Parental Consent
- If you are a parent or guardian, by allowing your child to use the App, you consent to these Terms on their behalf.
- You are responsible for any activity that occurs under your supervision.
4. User Accounts
The App does not require user registration or account creation. All app data and preferences are stored locally on your device.
5. In-App Purchases and Subscriptions
5.1 Premium Features
The App offers optional premium features ("Doodle Premium") through in-app purchases and subscriptions. Premium features may include:
- Unlimited access to all coloring pages
- Additional drawing tools and effects
- Ad-free experience
- Exclusive content and features
5.2 Payment
- All purchases are processed through Apple's App Store.
- You agree to pay all fees and applicable taxes incurred by you or anyone using your account.
- We do not have access to your payment information; all transactions are handled by Apple.
5.3 Subscription Terms
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period.
- You can manage and cancel subscriptions in your App Store account settings.
- Any unused portion of a free trial period will be forfeited when you purchase a subscription.
5.4 Refunds
- All purchases are subject to Apple's App Store refund policies.
- To request a refund, please contact Apple directly through their support channels.
- We cannot process refunds directly as all payments are handled by Apple.
5.5 Price Changes
- We reserve the right to change subscription prices at any time.
- Price changes will not affect current subscription periods but will apply to subsequent renewals.
- We will provide notice of price changes through the App or App Store.
6. User Content
6.1 Your Artwork
- You retain all rights to the original artwork you create using the App.
- Artwork is stored locally on your device and is under your control.
- We do not claim ownership of any content you create.
6.2 License to Us
- By using the App's sharing features, you grant us a non-exclusive, royalty-free license to display your shared content solely for the purpose of providing the sharing functionality.
- This license terminates when you delete the content or uninstall the App.
6.3 Coloring Page Assets
- The coloring page templates, stickers, patterns, and other assets provided in the App are owned by us or our licensors.
- You may use these assets within the App for personal, non-commercial purposes.
- You may not extract, redistribute, or sell our assets separately from the App.
7. Intellectual Property
7.1 Our Content
The App and its original content (excluding user-generated content), features, and functionality are and will remain the exclusive property of Doodle and its licensors. This includes but is not limited to:
- App design and user interface
- Coloring page illustrations
- Stickers, patterns, and effects
- Sound effects and animations
- Trademarks, logos, and branding
7.2 Restrictions
You agree not to:
- Copy, modify, or distribute the App or its content
- Reverse engineer, decompile, or disassemble the App
- Remove any copyright or proprietary notices
- Use our trademarks without prior written permission
- Create derivative works based on the App
8. Acceptable Use
8.1 Permitted Use
You may use the App for:
- Personal, non-commercial drawing and coloring activities
- Saving and sharing your artwork with family and friends
- Educational purposes
8.2 Prohibited Activities
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to the App or its systems
- Interfere with or disrupt the App's functionality
- Use the App to transmit harmful code or malware
- Misrepresent your identity or affiliation
- Use the App in any manner that could damage or overburden our services
9. Augmented Reality (AR) Features
9.1 AR Safety
When using AR features (BubbleAR):
- Be aware of your surroundings at all times
- Do not use AR features while walking, driving, or operating machinery
- Use in a safe, open space free of obstacles
- Supervise children when they use AR features
9.2 AR Data
- AR features use your device's camera for real-time rendering only
- No AR or camera data is stored or transmitted

10. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using the App, you consent to our Privacy Policy.
11. Third-Party Services
11.1 Apple Services
The App integrates with Apple services including:
- App Store for distribution and payments
- StoreKit for in-app purchases
- ARKit for augmented reality features
- ReplayKit for screen recording
Your use of these services is subject to Apple's terms and conditions.
11.2 Third-Party Links
The App may contain links to third-party websites or services. We are not responsible for the content or practices of any third-party sites.
12. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR COMPLETENESS OF CONTENT
- UNINTERRUPTED OR ERROR-FREE OPERATION
We do not warrant that:
- The App will meet your specific requirements
- The App will be available at all times
- Results from using the App will be accurate or reliable
- Any errors in the App will be corrected
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- IN NO EVENT SHALL DOODLE, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
- THIS INCLUDES, WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use or inability to use the App
- Any unauthorized access to your data
- Any third-party conduct on the App
- Any content obtained from the App
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.
14. Indemnification
You agree to defend, indemnify, and hold harmless Doodle and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you create or share through the App
15. Termination
15.1 By You
You may stop using the App at any time by uninstalling it from your device.
15.2 By Us
We reserve the right to:
- Suspend or terminate your access to the App at any time
- Modify or discontinue the App without notice
- Remove content that violates these Terms
15.3 Effect of Termination
Upon termination:
- Your right to use the App will immediately cease
- Locally stored data will remain on your device until you delete it
- Active subscriptions can be cancelled through your App Store settings
16. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes by:
- Updating the "Effective Date" at the top
- Providing in-app notification for material changes
Your continued use of the App after changes constitutes acceptance of the modified Terms.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the App developer is located, without regard to conflict of law principles.
Any disputes arising from these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of the applicable jurisdiction.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Doodle regarding the use of the App and supersede any prior agreements.
